LIMITED PAINTING AND STUCCO WARRANTY
Subject to the limitations stated below, for the period of time stated in your contract/estimate, starting on the day of completion of the work described in your contract/estimate, RC Home Improvements, LLC will repair all peeling, blistering, or chipping paint, or failing stucco due to defective workmanship.
This limited warranty does not cover:
1) Any work where RC Home Improvements did not supply the paint or materials used.
2) Any work which was not performed by RC Home Improvements.
3) Color fading, since the environment will naturally change the color and finishes over time.
4) Varnished surfaces.
5) Surfaces containing galvanized metal.
6) Surfaces that because of their design or location permit moisture to collect. These surfaces can include, but are not limited to, decks, railings, stairs, porches, roofs, and wood gutters.
7) Any repairs needed as a result of a defect in the materials used (this is the responsibility of the supplier if under warranty).
8) Bleeding caused by knots, rust, or cedar.
9) Cracks in drywall, caulking, plaster, or wood.
10) Cracking in stucco that is naturally expected due to expansion and contraction from temperature changes.
11) Any peeling, blistering, or chipping that was caused by:
a) mill-glazing from smooth cedar
b) ordinary wear and tear.
c) abnormal use, abuse, or misuse
d) structural defects.
e) settling or movement.
f) moisture build-up
g) abrasion or abrasive cleaning, mechanical damage, or damage resulting from the use of chemicals or cleaning agents or exposure to harmful substances.
h) damage or defects caused in whole or in part by reason of fire, explosion, flood, acts of God, extreme weather conditions, alterations, vandalism, negligence, or any other similar causes beyond the control of RC Home Improvements LLC.
The customer’s responsibility for this warranty to be valid:
1) The customer must have paid the contract in full.
2) Make the property accessible to RC Home Improvements and employees to perform the repairs on the agreed time and date
to repair.
Repairs under this limited warranty will be performed only on the specific areas where the peeling, blistering or chipping has
occurred and only to the level of surface preparation described in the original Contract.
THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY MADE BY THE CONTRACTOR AND IS IN LIEU OF ALL OTHER
WARRANTIES, EXPRESSED OR IMPLIED. THIS WARRANTY COVERS ONLY THOSE SERVICES PROVIDED BY RC PAINTING LLC TO
THE ORIGINAL PURCHASER NAMED ON THE FRONT OF THIS CONTRACT. IN NO EVENT SHALL THE CONTRACTOR BE LIABLE FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES OR DAMAGES IN EXCESS OF THE ORIGINAL CONTRACT PRICE. THIS WARRANTY MAY
NOT BE ALTERED OR EXTENDED FOR ANY PURPOSE UNLESS DONE SO IN WRITING IN A DOCUMENT EXECUTED BY ALL PARTIES
TO THIS CONTRACT.
CANCELLATION POLICY:
Should the customer need to cancel this contract on the other side of this page, he/she may do so at any time before the completion of this project, however will be responsible for reimbursing all materials already purchased for this project and any hours of labor already begun for this project to be charged at the current rate of $45.00 per hour as of (719) 433-1484. The reimbursement amount due at the time of cancelation shall not exceed the total estimated price without a Change Form signed by the customer. The customer should communicate not only verbally but also in writing to the office of RC Home Improvements LLC the desire to cancel as soon as possible.
PET POLICY
Should the customer have any pets, (i.e. cats, dogs, horses, etc.) it is the customer’s responsibility to contain them safely away from the
work areas so as not to be in harm’s way and to not harm the workers. RC Home Improvements will provide notice about the days of
scheduling your project to help you prepare your pets and belongings during that time. RC Home Improvements cannot be held responsible for any missing or injured pets.
